As part of FMCSA’s Driver Qualification File (DQF) requirements, motor carriers must not only obtain an updated Motor Vehicle Record (MVR) annually but also document the review of that record.
Key Regulation: 49 CFR § 391.25(a)
Requirement
Every motor carrier must, at least once every 12 months, request the driver’s motor vehicle record (MVR) covering the preceding 12 months from each driver’s licensing authority where the driver held a CMV license or permit during that period. eCFR
This annual MVR review replaces the older requirement under § 391.27, which previously required drivers to submit a list of violations. That section has been eliminated as of May 9, 2022.
What Carriers Must Do Annually
Obtain
Fetch the MVR from each applicable licensing authority.
Review
Examine the MVR for violations over the past year.
Retain
Place a copy of the MVR in the Driver Qualification File (DQF).
Document
Include a note in the DQF stating who performed the review and the review date.
There is no longer any requirement for drivers to prepare and submit a separate list or certification of violations. That obligation was rescinded effective May 9, 2022.
Why This Matters
Simplifies compliance: Carriers rely solely on official MVRs rather than driver-reported violation lists. Enhances accuracy: MVRs provide authoritative and standardized driving history. Ensures FMCSA compliance with § 391.25 — the central annual review rule.
